If you choose the capacity of the trustee/employee, you assume liability, but if you announce yourself as the beneficiary and executor and appoint the judge (or cop) as the trustee before the hearing starts, you’ll win no matter what. If you don’t do that, the judge will trick you by assuming role of executor and you will become the trustee by default.
